I think the FBI misunderstands. The ISPs are not "unwittingly" deleting those records. They are doing it for 2 reasons... The first, and most obvious, is that the logs take a LOT of friggin room/space. I don't see the FBI offering terabytes of hard drive space. The second is more simple. ISPs are run by hackers. Hackers believe in freedom and privacy.
